Terms of Service

These Terms of Service govern your access to and use of bitesim.com and your purchase and use of BiteSIM travel eSIM data plans.

By accessing the Site, placing an order or using a BiteSIM eSIM, you agree to these Terms of Service. If you do not agree, do not use the Site or purchase a BiteSIM eSIM.

In these Terms, “BiteSIM”, “we”, “us” and “our” refer to BITESIM LIMITED. “Customer”, “you” and “your” refer to the person who accesses the Site or purchases or uses a BiteSIM eSIM.

Our services

BiteSIM sells digital travel eSIM data plans for supported devices and destinations. BiteSIM does not provide physical SIM cards.

BiteSIM works with third-party eSIM fulfilment, connectivity and mobile-network partners to provide the services. The specific data allowance, validity period, destination, coverage, network type, activation policy and other plan details are shown on the relevant product page and at checkout.

BiteSIM is not a mobile-network operator. Network availability, speed, coverage and service quality may vary by destination, local network, device, location, network congestion and other factors outside our reasonable control.

Eligibility and customer responsibilities

You must provide accurate, complete and current information when placing an order, including a valid email address capable of receiving your order confirmation and eSIM delivery information.

You are responsible for ensuring that:

• Your device is eSIM-compatible.
• Your device is carrier-unlocked.
• Your device supports the applicable network bands in your destination.
• You selected the correct destination, data allowance and validity period before purchase.
• You follow the installation, activation, APN, mobile-data and roaming instructions provided with your eSIM.
• You comply with all applicable laws and regulations when using the service.

You must not use BiteSIM services for unlawful, abusive, fraudulent or harmful purposes. You must not interfere with, damage or misuse any network, system or service connected with BiteSIM.

You may not resell, transfer, distribute, reverse engineer or exploit BiteSIM eSIMs or services for commercial purposes without our prior written consent.

Orders and contract formation

Your order is an offer to purchase the selected eSIM plan. A contract is formed when we accept your order and send an order confirmation or eSIM delivery email.

We may refuse, cancel or limit an order where reasonably necessary, including where we suspect fraud, unauthorised payment, misuse, inaccurate information, technical error or a breach of these Terms.

If we cancel an order after payment has been successfully received and no service has been delivered or used, we will process a refund in accordance with applicable law and our Refund Policy.

Prices, payments and currency

Prices, available currencies, payment methods and any applicable taxes or charges are displayed on the Site or at checkout before you complete your purchase.

You are responsible for reviewing the total order amount before submitting payment. Your payment provider, card issuer or bank may charge separate fees, including foreign-exchange or transaction fees. BiteSIM is not responsible for such third-party fees.

Payments are processed by third-party payment service providers. BiteSIM does not intentionally store your full payment-card number or card security code.

Digital delivery

BiteSIM eSIMs are delivered digitally by email. After successful payment, you will normally receive an order confirmation and eSIM delivery information, including a QR code or installation details.

Delivery may be delayed due to payment verification, fraud-prevention checks, technical issues, incorrect email addresses or circumstances outside our reasonable control.

You are responsible for providing the correct email address at checkout. If you enter an incorrect email address, contact support@bitesim.com immediately. We will make reasonable efforts to assist, but we cannot guarantee recovery, replacement or refund if the eSIM has already been accessed, activated or used.

No physical product is shipped. No physical shipping fee applies to BiteSIM eSIM plans.

Activation, validity and data usage

Activation and validity rules vary by plan. Please review the relevant product page before purchase.

Unless otherwise stated on the product page, an eSIM may activate when it first connects to a supported mobile network in the destination. Some plans must be activated within a stated period after purchase.

The validity period begins in accordance with the activation policy shown on the applicable product page. Once the validity period ends, any unused data will expire and cannot be restored, extended or refunded unless required by applicable law or approved under our Refund Policy.

Data speeds and network technologies, including 3G, 4G and 5G, depend on local network availability, device compatibility and other factors. BiteSIM does not guarantee uninterrupted service, a particular speed, a specific network technology or coverage in every location.

Some destinations or network partners may require identity verification, registration or additional information where required by local law or network rules.

Fair use and network management

BiteSIM and its connectivity or mobile-network partners may apply reasonable network-management measures to protect network security, prevent fraud, comply with legal obligations and ensure fair access for users.

These measures may include restricting, suspending or terminating service where there is suspected fraud, abuse, unlawful use, excessive or abnormal usage, unauthorised resale, network interference or a breach of these Terms.

Refunds, cancellations and changes

Our Refund Policy forms part of these Terms of Service and explains when a refund may be available.

Because eSIMs are digital products that may be activated or used after delivery, refunds are not generally available for a change of mind, an incorrect purchase, an incompatible or carrier-locked device, or an eSIM that has already been used.

You may be eligible for a refund where a verified technical issue caused by BiteSIM or our connectivity provider prevents the eSIM from working as intended. Refund requests are assessed in accordance with our Refund Policy.

To request support or a refund, contact support@bitesim.com and provide your order number, device model, destination and relevant screenshots or technical information.

Support availability and response times are shown on our Contact Us page. We aim to respond within one business day, but response times may be longer during weekends, public holidays or periods of unusually high demand.

Privacy

Our collection, use, disclosure and protection of personal data are described in our Privacy Policy.

By using the Site or purchasing an eSIM, you acknowledge that we may process personal data as described in the Privacy Policy, including for order fulfilment, customer support, fraud prevention, service improvement and legal compliance.

You may unsubscribe from marketing emails at any time by using the unsubscribe link in the email or by contacting support@bitesim.com. We may still send essential transactional messages relating to your order or account.

Intellectual property

The Site, BiteSIM name, logos, text, graphics, images, content, software and other materials are owned by or licensed to BiteSIM and are protected by applicable intellectual-property laws.

You may use the Site only for lawful personal and non-commercial purposes. You may not copy, reproduce, modify, distribute, display, publish or create derivative works from Site content without our prior written consent, except where permitted by applicable law.

Third-party services and links

The Site may contain links to third-party websites, services, payment providers or network partners. These third parties operate independently from BiteSIM.

We are not responsible for the content, availability, privacy practices, terms or services of third parties. Your use of third-party services is subject to their own terms and policies.

Disclaimers

We make reasonable efforts to provide accurate information and reliable service. However, to the maximum extent permitted by applicable law, BiteSIM does not guarantee that the Site or eSIM service will always be available, uninterrupted, secure, error-free or compatible with every device or location.

Service quality may be affected by local network conditions, device limitations, coverage availability, network congestion, buildings, tunnels, underground locations, remote areas, weather, force majeure events, third-party system failures, government restrictions, maintenance, cyber incidents or other circumstances outside our reasonable control.

Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded or limited.

Changes to these Terms

We may update these Terms of Service from time to time to reflect changes in our services, business practices, legal obligations or operational requirements.

The updated Terms will be posted on this page with a revised Effective Date. The Terms in force at the time you place an order will apply to that order, unless a change is required by law or is necessary to address security, fraud or technical issues.

Governing law and disputes

These Terms are governed by the laws of Hong Kong.

Any dispute arising from or relating to these Terms, the Site or BiteSIM services will be subject to the jurisdiction of the courts of Hong Kong, except where applicable mandatory consumer-protection laws provide otherwise.
